GENERAL CONDITIONS OF CHARTER 1- The Charterer undertakes and hereby agrees that he/she shall not subcharter the yacht(s) or rent it to any third person(s) and that he/she shall not participate neither in regattas, yacht races nor in commercial activities or sailing schools. The charter contract will not be understood as a contract for transporting passengers. 2- The Charterer hereby confirms that he/she is familiar with all necessary navigational skills and that he/she possesses the valid license/certificate to navigate at the open seas. The Charterer's license/certificate to navigate will be presented to the Charteree together with passport or identification document. Both documents (certificate to navigate and identification document) should remain on board the chartered yacht until the period of charter is completed. A photocopy of both documents will remain under Charteree's possession. (Underage should present a permit from their parents or guardians) 3- When requested by the Charteree, the Charterers (person(s) in charge of sailing/navigation) have to prove that they are capable to operate yacht safely and according to international maritime laws/rules. Besides, if the Charterers do not comply with regulations relative to boat/yacht seaworthiness the Charteree will assign a capable skipper whose expenses will be charged to the Charterer. If the Charterer do not accept to pay the fee and expenses of the skipper assigned by the Charteree, under these conditions, the Charteree has legal right not to hand over the boat/yacht at all. 4- The Charteree is obligated to hand over the yacht(s) to Charterer's disposal without any fault, clean and dry with full fuel and water tanks in the agreed time and place. If for any reason the Charteree did not fulfil above mentioned conditions the Charterer has right to claim for money refund or for the exact period of time he has not been able to use the yacht.
5- It is not allowed to bring on board fire arms (not even with license), drugs, illegal substances, explosives, hazardous products or any other article or product which is banned by the current international laws. 6- It is hereby agreed that Cahrterers will not navigate/operate the yacht under influence of alcohol, narcotics or any other illegal substances unknown to Charteree. 7- Fees a-) The fees include: boat/yacht with standard equipment for sailing, berth at base port, bed cloth, insurance. b-)The fees do not include: berths at ports different from the base port, diesel (main engine), gasoline (auxiliary motored raft), gas (for cooking), food supplies, or any other concept that has not been especified. It should also be taken into account other extra expenses according to Charteree's fees for outboard motor, final cleaning, etc. 8- Charter a berth Depending on the season and on the capacity of berths of the boat/yacht, it will be required a certain number of berths to be chartered in order to carry out the charter.The specific boat/yacht corresponding to each chartered berth will be determined once the booking period has been closed. 9- Payment conditions 50 % of the charter fee upon signature of contract between parties involved. Rest of the charter fee (the other 50 %) at least four weeks before commencement of the charter. 10-Cancellation conditions The Charterer will pay: 10 % of the amount of the charter fee when cancelling the charter 3 (three) months before the charter commencement date. 30 % of the amount of the charter fee when cancelling the charter 1 (one) month before the charter commencement date. 80 % of the amount of the charter fee when cancelling the charter during the previous 29 (twenty-nine) days before the charter commencement date. 11- Yachts security deposit. The security deposit has to be done in the starting marina by the charterer when taking over of the yacht. Deposit can be made and accepted in: cash or credit cards. The security deposit shall be refunded in full amount unless the existance of damage or defect on the yacht or its equipment is found during the take over of the yacht. In case of loss or damage of the equipment, particular parts of the yacht or the yacht itself Charteree shall retain exact amount from the security deposit, that matches the value of repair, acquisition and/or purchasing the equipment or particular part of te yacht. In case the caused damage has the consequence that the yacht can not be further chartered, Charteree has the right to retain the amount which matches the loss of profit. 12- Embarkments and disembarkments Embarkments and disembarkments will be scheduled according to the conditions stated in each contract (in case that a specific contract has been signed by Charteree and Charterer). If charter contract is signed by the parties involved (Charteree and Charterer) following the general conditions of charter, embarkments and disembarkments will go as it follows: One Day.............Embarkment at 10:00 hrs. Disembarkment at 18:00 hrs. Weekends..........Embarkment at 10:00 hrs. Disembarkment at 18:00 hrs. Weeks................Embarkment at 12:00 hrs. Disembarkment at 16:00 hrs. The intention of Charterers of carrying out Embarkments and disembarkents that not match the above schedule shall be notified in advance to Charteree. The Charterer shall also pay in advance the amount of money corresponding with his request. Embarkment previous day of the commencement date of charter (at 21:00 hr): 120 Euros Disembarkment one day after the completion charter date (at 08:00 hrs): 120 Euros If boat/yacht is not hand over in time by Charterer he/she will be penalized with 60 Euros per each hour of delay after the completion charter date. 13- The route will be basically chosen by the Charterer (client). However, the skipper (in case of skippered charter) will be responsible for the final decision and always taking into account weather conditions. If weather conditions are not safe for navigation and the skipper decides that departure should be delayed or even cancelled, that decision shall not be appealed or questioned by Charterer. Bad weather conditions will not result in cancelling the charter unless these weather conditions are a threat to safe navigation. If Charterer insists on cancelling the charter when weather conditions permit safe sailing the Charterer will have no right to claim for any refund. 14- The Charterer shall pay 80 Euros for final cleaning being this clause non negotiable. 15- Any kind of change on any of the above stated charter conditions should be previously accepted by Charteree.
